Training Service Agreement / Terms & Conditions

This Training Service Agreement ("Agreement") is made effective upon enrolment and fee payment by the Candidate/Trainee, by and between:

INAAC, a sole proprietorship entity having its registered office at: A-48, Gulab Bagh, Main Najafgarh Road, Opposite Metro Pillar No. 748, Uttam Nagar, Delhi – 110059, India, (hereinafter referred to as “INAAC” or “Service Provider”, which expression shall, unless repugnant to the context or meaning thereof, be deemed to include its successors, assigns and authorized representatives),

AND

The individual person enrolling in the automobile retail sales training course provided by INAAC, whose details are captured at the time of registration, (hereinafter referred to as the "Trainee" or "Candidate", which expression shall, unless repugnant to the context, include his/her legal heirs, representatives, and permitted assigns).

INAAC and the Trainee shall collectively be referred to as the “Parties” and individually as a “Party.”

1. Why Choose This Program?

This Agreement outlines the terms and conditions under which INAAC shall provide automobile retail sales training to the Trainee. The Agreement also specifies the responsibilities, rights, and obligations of both Parties in relation to course delivery, assessment, placement support, and refund policies.

2. Course Enrollment and Fees

2.1 The Trainee agrees to enroll in the automobile retail sales training course offered by INAAC via its platform www.inaac.in.

2.2 The course fee shall be as per the current fee schedule published on the website or communicated directly by INAAC. The Trainee agrees to pay the course fees in full and on time.

2.3 In case the Trainee is opting for a placement-related course, the minimum fee applicable for job guarantee eligibility is Rs. 33,333 + GST per month, irrespective of the total cost of the course.

3. Course Attendance & Assessments

3.1 Trainee must maintain minimum 90% attendance throughout the training duration.

3.2 At the end of the course, the Trainee shall be required to appear for a final assessment, and must secure a minimum of 80% marks to qualify for the Job Guarantee clause mentioned herein.

3.3 Attendance and assessment performance shall be duly documented by INAAC and shall be considered final and binding unless proven otherwise with valid evidence by the Trainee within Three (3) days of results being declared.

4. Job Guarantee Policy

4.1 Only those Trainees who meet all the following criteria shall be eligible for Job Guarantee:

  • Opted for the placement-related course costing at least Rs. 33,333 + GST per month;
  • Attained minimum 90% attendance;
  • Successfully passed the final assessment with at least 80% score.

4.2 The Job Guarantee shall be construed to mean that INAAC will facilitate a minimum of 3 interview opportunities within 100 days from the date of successful course completion.

4.3 INAAC does not guarantee a job offer, but guarantees facilitation of interview opportunities with potential employers limiting to 3 in the retail sales industry.

5. Refund Policy

5.1 If the Trainee, after successfully fulfilling all conditions under Clause 4.1, does not receive a minimum of three (3) interview opportunities within 100 days post course completion, then the Trainee shall be eligible for a refund of 50% of the total fees paid for the course.

5.2 The refund shall be processed within 30 working days from the date of receipt of the refund request by the Trainee, provided the Trainee has met all eligibility conditions under Clause 4.1.

5.3 No refund shall be provided:

  • If the Trainee fails to meet attendance or assessment criteria;
  • If the Trainee does not opt for the placement-related course as defined;
  • If the delay in placement is due to non-cooperation, absenteeism, or lack of availability from the Trainee’s side.

6. Trainee Obligations

The Trainee agrees to:

  • Attend all scheduled sessions with seriousness and punctuality;
  • Maintain discipline and decorum throughout the course;
  • Participate in mock interviews and preparatory sessions conducted by INAAC;
  • Cooperate with INAAC’s placement cell and provide accurate information for job placement activities.

7. Intellectual Property

7.1 All course materials, content, presentations, and proprietary resources provided by INAAC remain the exclusive intellectual property of INAAC.

7.2 The Trainee shall not reproduce, copy, share, distribute, or commercially exploit any part of the training materials without prior written consent of INAAC.

8. Confidentiality

The Trainee shall maintain strict confidentiality regarding any proprietary information, employer contacts, or trade practices shared during or after the course.

9. Limitation of Liability

INAAC shall not be liable for:

  • Any delay or failure in arranging interviews caused by acts of God, force majeure events, or reasons beyond its control;
  • Any decisions made by employers or third-party placement agencies;
  • Any damages, including loss of opportunity or earnings, arising from use of the training or placement services.

10. Termination

10.1 INAAC reserves the right to terminate the Trainee’s enrollment under the following circumstances:

  • Breach of terms;
  • Misconduct or indiscipline;
  • Non-payment or delayed payment of fees;
  • Misrepresentation of facts.

10.2 Upon termination, the Trainee shall not be eligible for any refund or job guarantee benefits.

11. Dispute Resolution

11.1 Any disputes arising out of or related to this Agreement shall be first attempted to be resolved through mutual negotiation and mediation.

11.2 Failing resolution, the matter shall be subject to exclusive jurisdiction of courts at Delhi, India.

12. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of India, including the Indian Contract Act, 1872, Consumer Protection Act, 2019, and other applicable statutes.

13. Amendment and Severability

13.1 INAAC reserves the right to amend these terms from time to time. Updated terms shall be posted on www.inaac.in and shall be binding from the date of publication.

13.2 If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

14. Entire Agreement

This document, including any annexures or policies referenced herein, constitutes the entire agreement between the Parties, superseding any prior communications or agreements, oral or written.

15. Mentorship Program

15.1 Facilitation: INAAC shall facilitate a mentorship program for Trainees who express interest in availing mentorship support. This mentorship will be available for a period of one (1) year from the date of successful course completion.

15.2 Renewal & Consent: The mentorship program may be renewed annually, subject to mutual consent. The Trainee must initiate the renewal process. Renewal shall be subject to:

  • Written request by the Trainee,
  • INAAC’s approval,
  • Terms and conditions as published by INAAC at the time of renewal,
  • Any additional charges, if applicable as guided by INAAC.

15.3 Nature of Mentorship: The program is advisory in nature, meant to provide guidance. It does not guarantee employment, promotion, or financial success.

15.4 Trainee Responsibility: The Trainee is solely responsible for any decisions or outcomes based on mentorship advice. INAAC shall bear no liability for the same.

15.5 Right to Modify or Discontinue: INAAC reserves the right to modify, suspend, or terminate the mentorship program or its terms at any time, with proper communication on www.inaac.in.
